ACCRETION DIGITAL'S Terms & Conditions

1. Services Overview

Accretion Digital provides customized marketing and sales services tailored to meet the unique needs of your business. Our services range from strategic consulting to complete outsourcing of your marketing and sales departments. Specific service details are outlined in your individual proposal and contract.


2. Payment Terms

  • Transparency: All service prices are clearly specified in your individual proposal and/or invoice. There are no hidden fees.
  • Due Dates: Payments must be made by the dates specified on your invoice. Late payments may incur additional charges.
  • Additional Services: Any services requested beyond those outlined in your initial agreement will be clearly itemized and billed accordingly.


3. Project Management

  • Timeliness: The project timeline greatly depends on your prompt feedback and cooperation. Delays in communication may result in changes to the delivery schedule.
  • Single Point of Contact: We recommend designating a single point of contact from your side to streamline communications and decision-making.


4. Intellectual Property

  • Client Materials: You confirm that you have the appropriate rights for any materials provided for the project. Accretion Digital is not liable for any infringement issues arising from materials provided by you.
  • Ownership: Upon final payment, you gain ownership of the final delivered product. Accretion Digital retains ownership of all preliminary materials not included in the final version.


5. Use of Work in Portfolio

Unless expressly requested otherwise, Accretion Digital reserves the right to include completed projects in our portfolio and to claim authorship for promotional purposes.


6. Confidentiality

We treat all client information as confidential and will not disclose or reproduce your data without prior authorization, except as required to fulfill our contractual obligations.


7. Revision and Refunds

  • Revisions: You are eligible for up to 3 hours of free revisions on deliverables within 30 days of project completion, ensuring your satisfaction with our work.
  • Refunds: Refunds are available, minus the costs of labor and expenses already incurred. No refunds are issued for the initial deposit or for time spent on research, development, and administrative tasks.


8. Legal and Compliance

  • Governing Law: These terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under these terms will be handled in an appropriate jurisdiction.
  • Amendments: Accretion Digital reserves the right to amend these terms at any time. Clients will be notified of significant changes.


9. Affiliate Program Structure

Affiliates are eligible to earn commissions either through a percentage of sales or a flat rate, depending on the terms in place at the time of their enrollment. The commission structure is subject to change and will be displayed during the affiliate sign-up process. Affiliates will be notified of any changes in the commission structure via email.


10. Payout Terms

Affiliates will receive monthly payouts via Stripe, provided that the affiliate's earnings exceed the minimum payout threshold as displayed in their affiliate dashboard. Payouts are processed within 30 days of the end of each calendar month. It is the affiliate's responsibility to provide accurate payment information. Accretion Digital is not responsible for delays due to incorrect payment details.


11. Affiliate Restrictions

Affiliates must be approved by Accretion Digital prior to joining the affiliate program. This process ensures that all affiliates receive and agree to follow our brand guidelines, which include the appropriate use of our logos, colors, and messaging. Accretion Digital reserves the right to deny any affiliate application at its sole discretion.


12. Promotional Guidelines

Once approved, affiliates will be provided with detailed promotional guidelines outlining how to use our brand assets, including logos, colors, tone of voice, and target audience demographics. Affiliates are expected to strictly adhere to these guidelines to maintain brand consistency. Any failure to comply may result in immediate termination from the affiliate program.


13. Termination of Affiliates

Accretion Digital reserves the right to terminate any affiliate relationship for the following reasons, including but not limited to:

  • Engaging in fraudulent or unethical activities, such as generating false leads or sales.
  • Attempting to create a sub-affiliate network or referring others to promote on their behalf.
  • Violating our brand guidelines or misusing our intellectual property.
  • Engaging in activities that could harm Accretion Digital’s reputation or brand.
  • Participating in illegal activities or violating advertising laws.


Upon termination, Accretion Digital may withhold any unpaid commissions at its sole discretion if the termination is due to a violation of these terms.


14. Affiliate Liability

Affiliates are responsible for complying with all relevant advertising laws, consumer protection laws, and any other legal regulations that apply to promoting Accretion Digital’s services. Accretion Digital will not provide legal protection to affiliates in the event of any legal issues arising from their activities. Furthermore, Accretion Digital reserves the right to take legal action and seek damages if an affiliate’s actions harm the company’s brand or business.


15. Tracking and Attribution

Each affiliate will receive a unique tracking link and/or promo code. Accretion Digital uses advanced tracking software to credit affiliates for sales or leads originating from their referral. Even if a customer does not use the affiliate’s link on a future purchase, the initial referral will still be attributed to the affiliate, provided the customer was originally referred by them. In case of any tracking disputes, Accretion Digital’s decision will be final.


16. Governing Law

The affiliate program is governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.

Do you guarantee results from SEO and ads?

We guarantee improved visibility within 90 days. Exact leads, calls, or sales depend on your business, audience, and responsiveness.

Will I own my website and have full access?

Yes. Once your website is live, you have complete ownership and access. You can make updates yourself if you choose, or we can manage it for you.

Can I approve social media posts before they go live?

Yes. We can set up an approval process so you see and approve content before it is posted.

Can you work with my industry or business type?

Yes. We have experience with local businesses, medical practices, therapists, and political campaigns across multiple states. We tailor strategies for your industry.

How often will you post on social media and manage my pages?

We schedule content according to your package. Typically, posts go out 3 to 5 times per week for active social media management. Engagement and inbox monitoring are included where specified.
